These Terms of Use (“Terms”) govern your access to and use of the Connekct website and AI phone answering service (the “Service”), operated by Connekct (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service, you represent that you meet these requirements.
Connekct provides an AI-powered phone answering service that answers inbound calls on behalf of your business, screens callers, captures job or intake details, and sends summaries to you. We configure and manage your AI agent as part of our white-glove onboarding process.
The Service is provided on a subscription basis. Features and capabilities vary by plan. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
You agree not to use the Service to:
The Service records and transcribes phone calls. You are solely responsible for complying with all applicable federal, state, and local laws regarding call recording, including providing any required disclosures or obtaining consent from callers in your jurisdiction. Connekct provides a default caller disclosure; you must not disable or circumvent it.
We are not liable for any failure on your part to comply with call recording laws.
Subscription fees are billed in advance on a monthly or annual basis depending on your plan. All fees are non-refundable except as required by law or as expressly stated in your order. We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
If payment fails, we may suspend or terminate your account after reasonable notice.
We may offer a free trial period. At the end of the trial, your account will convert to a paid subscription unless you cancel before the trial ends. We reserve the right to modify or discontinue free trial offers at any time.
All content, software, and technology comprising the Service is owned by Connekct or its licensors and protected by intellectual property laws. These Terms do not grant you any right to use our name, logo, or branding.
You retain ownership of your business data and content. You grant us a limited license to use that data solely to provide and improve the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED RESPONSES WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTPHONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Connekct and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You may cancel your account at any time through your account settings or by contacting us. We may suspend or terminate your access for violation of these Terms, non-payment, or any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Johnson County, Kansas.
We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on this page with a new effective date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
